Psych reports suggest man convicted of 'sextortion' may have been not criminally responsible during offence

The defence is considering whether or not to proceed with a not criminally responsible (NCR) hearing for a man who used a fake Facebook profile to lure and extort a 17-year-old girl.

In February, 22-year-old Abdul Jat was convicted in Saskatoon Court of Queen’s Bench of child luring, extortion and possession and distribution of child pornography.

Before proceeding to sentencing, Jat was remanded to Saskatchewan Hospital in Battleford. The defence requested a 30-day NCR assessment to determine if he was suffering from a mental disorder when he committed the offence. If so, the defence argued, Jat may not have appreciated the nature and consequences of his acts.

During Jat’s trial, court heard he was diagnosed with having a “mild intellectual disorder.” On Monday, the Crown said the NCR assessment suggested that Jat may have been not criminally responsible at the time of the offence. No other details were provided.

The case has been adjourned until May 1 to determine how to proceed.

Jat used fake Facebook accounts to convince a 17-year-old girl to send him nude photos in July 2016. When the girl did send photos, thinking they were going to someone else, Jat told her he would leak the photos if she didn’t have sex with “Abdul,” Justice Neil Gabrielson determined.
